City Attorney Terpstra reported that the contracts for City Administrator and City Attorney were discussed, but no decisions were made.


REGULAR MEETING


The meeting was called to order as indicated at 7:00 p.m., and Ripon Police Officer Michelle Snaer introduced the students who performed the Pledge of Allegiance in sign language.


Vice Mayor Winn thanked Officer Snaer for her work with PAL and recognized Fire Chief Bitters, Police Chief Bull, and Carolyn Jensen as members of the PAL Board.

PUBLIC DISCUSSION: Thom Patton, Ripon, said he sent an e-mail to each Council Member about a letter he sent to the Manteca Bulletin, but he has not received a response. He said he cannot understand why the Council would approve a fireworks display without prior approval from Chief Bitters. He asked why the Council does not have contact with the Fire District. He said that there should be open bidding for the fireworks show. He also asked why the contract was on the Consent Calendar. He said the Council should be more concerned about public safety than worrying about skate parks and shopping center aisle widths.


Mayor Pernice said that skate parks and shopping center aisle widths are also important. He said that some people get upset with the Council because his/her pet peeve is not treated as the most important, but the Council is multifaceted and can deal with many issues.


City Attorney Terpstra said that the Council never refers to outside agencies about contracts the City is considering. The City has held meetings on the fireworks show, but the terms are between the City and the firm, not between the firm and another agency. The show is a professional services contract, and the City does not go out to competitive bidding for professional services. He said that Council and staff do talk to the Fire District about the logistics and safety of the show. He said the cost of the show is budgeted every year, and the contract is not new to the Council. The one change was that this year the firm offered an alternative contract for a 3-year term.


Vice Mayor Winn said that when he was Mayor, he tried to set up a joint meeting with the Fire District, but they could never find a date that would work for everyone. He said the Fire District always regulated the fireworks show. The Fire District makes sure the show is legal. The Fire Chief and the Fire Marshall have the power to cancel the show if they do not give approval.
