California's Mandatory Commercial Recycling Law

MCR:  Mandatory Commercial Recycling (AB 341)

Per California State Law AB 341, businesses that generate 4 or more cubic yards (CY) of waste a week are required to have recycling services. Businesses that have a 4 Yard bin or larger, or empty a smaller bin multiple times that is  equivalent to  4 CY  in a week, fall into this category regardless if it is completely filled. To reduce your bin size please contact your waste hauler

All multi-family residences with 5 or more units, regardless of weekly trash generation, are also required to have recycling services.

Recycling may be done by:

  • Self-haul
  • Subscribe to hauling service
  • Arrange for pick up of recyclable materials
  • Subscribe to a recycling service that may include mixed waste processing that yields diversion results comparable to source separation.

MORe:  Mandatory Organics Recycling (AB 1826)

Per California State Law AB 1826, businesses that generate 2 or more CY of waste per week and multi-family properties of 5 units or more are required to recycle their organic waste.  Organic waste includes food waste, food-soiled paper waste, and landscaping waste (grass clippings, tree trimmings, etc.). Multi-family residences of 5 units or more are not required to recycle food wastes.

The purpose of this mandatory commercial organics recycling law (AB 1826) is to reduce greenhouse gas emissions by diverting commercial organic waste from landfills and transforming it into reusable products through composting, anaerobic digestion, or incineration.  

What is organic waste?

Recyclable organics may include:

  • Food material resulting from the processing, storage, preparation, cooking, handling, or consumption of food.
    • Discarded meat scraps, dairy products, egg shells, fruit or vegetable peels and trimmings
    • Other unused, expired, or otherwise unwanted food items
    • Food-soiled paper products such as used napkins, paper towels, paper plates, and paper cups
  • Landscaping waste
    • Leaves, grass clippings, plants, and seaweed
    • Pruning’s, shrubs, and small branches and stumps
    • Wood waste (non-hazardous)*

*Check with your waste hauler for allowable wood wastes.

Mandatory Recycling California Law AB 827:

Per California Law AB 827, MCR and MORe requires businesses, public entities, and Schools to provide organics and recycling containers at front-of-house to collect waste generated from products purchased and consumed on the premises. These containers must be placed adjacent to trash containers and be visible, easily accessible, and clearly marked. Full-service restaurants do not have to provide containers for patrons but must provide containers for employees to separate post-consumer recyclable and organics for customers.
